DarkMatch Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and onEins LLC, 3833 Powerline Rd, Suite 101-K, Fort Lauderdale, Florida 33309, United States (“onEins,” “we,” “us,” or “our”). These Terms govern your access to and use of the DarkMatch iOS application, DarkMatch+ subscriptions, consumable Gem purchases, the DarkMatch website, and related services (together, the “Service”).

By downloading, accessing, or using DarkMatch, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.

1. What DarkMatch Is

DarkMatch is an adults-only interactive fiction and entertainment service. It lets you browse, match with, message, receive images from, and in some cases speak with fictional AI-powered characters. Conversations influence relationship state, authored story progression, and character memory.

Every DarkMatch character is fictional. You are not communicating with a real dating partner, romantic prospect, therapist, adviser, emergency service, or representative of any person depicted by an image.

2. Eligibility and Adults-Only Requirement

You must be at least 18 years old and legally capable of entering these Terms to use DarkMatch. You may not use the Service if you are under 18 or legally barred from receiving the Service, including under applicable sanctions or export-control laws.

We may suspend or delete an account when we reasonably believe the user is under 18 or has provided false age information.

3. Apple App Store Terms

DarkMatch is distributed through the Apple App Store. Your use is also subject to Apple’s Media Services Terms, App Store rules, usage rules, and any other terms applying to your Apple Account, device, purchases, subscriptions, and Apple services.

These Terms are between you and onEins, not Apple. onEins, not Apple, is responsible for DarkMatch, its maintenance, support, and claims relating to the Service, except as otherwise required by law. Apple has no obligation to provide maintenance or support.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use DarkMatch on Apple-branded products you own or control as permitted by Apple’s usage rules. If DarkMatch fails to conform to an applicable warranty that cannot legally be disclaimed, you may notify Apple, and Apple may refund the purchase price for the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Apple-related provisions and may enforce them.

4. Anonymous Account and Profile

DarkMatch creates an anonymous device-based account. You are responsible for your device and for the information submitted through the account. An account may not automatically transfer to another device unless a supported Apple restore or account-transfer mechanism is available.

You agree to provide truthful age information and not impersonate another person. Profile names do not need to be legal names, but they may not be used deceptively or unlawfully.

5. Free Access, DarkMatch+, and Gems

DarkMatch may offer limited free messages, swipes, or other features. Limits and benefits can change as the Service evolves.

DarkMatch+ is an optional auto-renewable subscription. Available periods may include weekly, monthly, and quarterly plans. The exact plan, billing period, current price, included Gems, and benefits are shown in the app and in Apple’s purchase sheet before you confirm.

Gems are consumable digital items that may be used for features such as super likes and character images. Gems have no cash value, are not legal tender, may not be transferred or resold, and are not redeemable for money except where required by law. The number of Gems and the feature price are displayed before purchase or use.

6. Subscription Renewal, Cancellation, and Refunds

DarkMatch+ subscriptions are purchased through Apple and billed to your Apple Account. Unless canceled, a subscription renews automatically at the end of each billing period. You can manage or cancel it in yourApple Account subscription settings. Deleting DarkMatch or deleting your DarkMatch account does not cancel an Apple-billed subscription.

Apple handles App Store billing, cancellation, and refund requests. We cannot directly cancel, refund, or modify an Apple-billed transaction. If a purchase is canceled, refunded, revoked, expires, or fails verification, related access or Gems may be removed to the extent permitted by law.

7. AI Characters and Generated Output

Character messages, images, memories, and voice responses may be generated or assisted by artificial intelligence. AI output can be inaccurate, inconsistent, repetitive, unexpected, offensive, or unsuitable for your circumstances. A character may appear emotionally aware, but it has no consciousness, feelings, personal knowledge, or real-world relationship with you.

Do not rely on DarkMatch for medical, mental-health, legal, financial, safety, relationship, or other professional advice. DarkMatch is not therapy, a crisis service, or a substitute for real human support. If you face an emergency or immediate danger, contact local emergency services or a qualified professional.

8. Mature Themes and Safety Boundaries

DarkMatch is intended for adults and may include fictional romance, suspense, jealousy, conflict, morally gray themes, violence references, flirtation, and mature or suggestive dialogue. Content availability may vary by character, story, user choices, provider limitations, location, and platform requirements.

The Service does not permit sexual exploitation, content involving minors or age-ambiguous persons in a sexual context, non-consensual sexual content, trafficking, illegal sexual content, or instructions to cause real-world harm. We may filter, refuse, remove, or report content when necessary for safety, legal compliance, or platform rules.

9. Your Content

“User Content” includes profile text, photos, messages, voice input and transcripts, support requests, and other information you submit through the Service. You retain ownership of your User Content.

You grant onEins a limited, worldwide, non-exclusive license to host, process, transmit, reproduce, display, analyze, moderate, and create technical or generated outputs from User Content only as reasonably needed to provide, secure, operate, support, and improve the Service. This includes sending relevant information to AI, image-safety, voice, hosting, and purchase providers described in our Privacy Policy.

You are responsible for ensuring that you have the rights and permissions needed for anything you submit. Do not upload another person’s private or intimate image without permission.

10. Photos and Voice Calls

Photos may be safety-classified and rejected. The fact that an upload is accepted does not mean onEins endorses it or confirms the identity, age, ownership, or legality of the image.

Voice calls use a third-party real-time voice provider. Audio quality, availability, transcription, and generated responses may vary. Calls may be transcribed and summarized to maintain story continuity as described in the Privacy Policy. You agree not to use voice calls to violate another person’s privacy or recording laws.

11. Reporting, Blocking, and Support

DarkMatch may provide tools to report or locally hide a character interaction. You may also report safety concerns at[email protected]. Include only the information reasonably needed to investigate.

We may review relevant account, message, image, or call information when necessary to investigate a report, enforce these Terms, or protect users and the Service.

12. Acceptable Use

You agree not to:

Use DarkMatch if you are under 18 or help a minor access it.
Use the Service for illegal, fraudulent, abusive, harassing, exploitative, or unauthorized purposes.
Submit content involving child sexual abuse, minors in sexual contexts, trafficking, non-consensual intimate imagery, or unlawful exploitation.
Upload content that infringes intellectual-property, privacy, publicity, confidentiality, or other rights.
Attempt to identify, contact, impersonate, or misrepresent a fictional character as a real person.
Attempt to bypass age gates, content safeguards, subscription checks, paywalls, Gem balances, transaction verification, rate limits, or security controls.
Reverse engineer, scrape, probe, overload, attack, or interfere with the Service, except where such a restriction is prohibited by law.
Use automated systems to access DarkMatch without written permission.
Use generated content for deception, scams, impersonation, harassment, or real-world harm.

13. Intellectual Property

DarkMatch’s software, interface, characters, character biographies, authored storylines, prompts, artwork, branding, logos, text, audio, and other materials are owned by onEins or its licensors and protected by intellectual-property law.

Except for the limited license granted to you, we reserve all rights. You may not copy, sell, sublicense, distribute, publicly exploit, or create derivative commercial services from DarkMatch without written permission, except where permitted by law.

14. Third-Party Services

DarkMatch depends on third parties including Apple, Cloudflare, CometAPI, underlying AI model providers, and Cartesia. Mixpanel and AppsFlyer may be used in future distributed versions for analytics and attribution. Third-party services have their own terms, privacy practices, availability, and technical limitations. We are not responsible for third-party services outside our reasonable control.

15. Service Changes and Availability

We may add, update, limit, suspend, or discontinue features, characters, story content, prices, free limits, AI providers, voice calls, image generation, subscriptions, or Gem uses. Material subscription changes will be handled under Apple’s rules and applicable law.

We do not guarantee uninterrupted or error-free operation, permanent availability of a particular character or provider, preservation of every conversation, or that generated output will meet your expectations.

16. Account Deletion, Suspension, and Termination

You may delete your account in DarkMatch Settings. Account deletion permanently removes data held in our active account systems as described in the Privacy Policy. It does not cancel an Apple subscription or erase records controlled by Apple.

We may suspend, restrict, or terminate access if we reasonably believe you violated these Terms, are under 18, created risk for users or the Service, attempted fraud or abuse, or if required by law or a platform provider.

17. Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, and protect information. By using DarkMatch, you acknowledge that information will be processed as described there.

18. Disclaimers

To the maximum extent permitted by law, DarkMatch and the Service are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and reliability.

We do not warrant that generated content will be accurate, appropriate, consistent, emotionally beneficial, or safe to rely on; that relationships or story progress will be preserved indefinitely; or that the Service will be uninterrupted, secure, or error-free. Mandatory consumer rights remain unaffected.

19. Limitation of Liability

To the maximum extent permitted by law, onEins and its owners, employees, contractors, affiliates, providers, and licensors will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, or for lost profits, lost data, emotional reliance, subscription interruption, device issues, or inability to use the Service.

To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid for DarkMatch through the App Store during the 12 months before the event giving rise to the claim, or (b) USD $50. These limits do not apply where prohibited, including to liability that cannot lawfully be limited.

20. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless onEins and its owners, employees, contractors, affiliates, providers, and licensors from claims, damages, losses, liabilities, costs, and expenses arising from your User Content, misuse of the Service, violation of these Terms, or violation of law or third-party rights.

21. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules, except where mandatory consumer law requires otherwise.

Before filing a claim, please contact us and attempt informal resolution. If a dispute cannot be resolved, the state and federal courts in Broward County, Florida will have exclusive jurisdiction, except where applicable law gives you the right to bring a claim elsewhere. Nothing in these Terms limits mandatory consumer, privacy, or other rights in your place of residence.

22. Changes to These Terms

We may update these Terms. If changes are material, we will provide notice through the app, App Store listing, website, or another reasonable method. The revised Terms are effective when posted or on the date otherwise stated.
